Swan Telecom director Vinod Goenka denies cheating charges in 2G scam

NEW DELHI: Swan Telecom director Vinod Goenka denied charges of cheating and conspiracy in the 2G scam, stating that he had no role in obtaining mobile permits from former telecom minister A Raja as he only looked after the realty business while managing director Shahid Balwa was responsible for telecom.

Claiming innocence, Goenka's legal counsel KG Menon said the Central Bureau of Investigation (CBI) did not have any evidence against his client and was incriminating him for holding a director's position in the company. He told the CBI Special Court that Balwa , who is also facing charges, was the signatory authority who also held power of attorney. "To obtain 2G licence, Balwa was given the power of attorney by the company (DB Realty). Balwa was handling the telecom sector while my client (Goenka) was only in the business of real estate," Menon said.

Goenka has been in prison for the last four months and was charged by the CBI for cheating and conspiracy. Menon picked holes in the CBI's chargesheet and said that Goenka's offences were not specified yet he was made part of a conspiracy for merely knowing Raja and visiting his residence in 2005, during Raja's tenure as the minister of environment and forests. "The charge must say how have I made an offence... Is it a crime to know Raja? ... Visits to the minister's cannot make you a conspirator," he said in Special CBI Court on Wednesday.

Insisting that Goenka did not participate in giving or getting illegal gratification , Menon pointed out that his client had not signed any cheque and no funds of Swan had been used for giving any bribe. "My client never participated in anything except that he took share in Swan," Menon said. He added that . 200 crore went from Dynamix Realty and not DB Realty that was one of Dynamix Realty's three partner firms.

CBI in the first chargesheet alleged that a 'bribe' of . 200 crore had been channelised from Balwa's DB Realty to DMK-run Kalaignar TV through a "circuitous route" via Cineyug Films and Kusegaon Fruits and Vegetables Pvt Ltd for grant of licence to Swan. Shifting the blame on CBI, the legal counsel added that the probe agency was ignoring the government's policy, recommended by telecoms regulator Trai, which did not support auction of mobile permits and did not revise entryfee .

Moreover, the government had established that it suffered no loss by following the policy, which was also implemented by Raja.
